A flight attendant allegedly misinterpreted the interaction and mistakenly suspected the father was abducting his daughter or behaving inappropriately with her. The misunderstanding was reported to the Delta Air Lines station manager in Newport News, who then alerted law enforcement without properly verifying the facts, the complaint states.

When the plane landed, armed police were waiting, and they immediately separated Madison from her family and questioned her father. After questioning, authorities concluded there was no possibility of arresting or charging Nicholas Cupp, meaning the suspicion of trafficking was not supported by evidence, USA Today reported.

Madison suffered emotional distress, stomach pains, vomiting and a chronic fear, particularly of being in public with her father again, the lawsuit said. The family accuses Delta and Endeavor of negligence, false imprisonment and intentionally causing the incident to cause emotional distress.

Previous court cases and new filings

Madison’s father had filed a separate lawsuit in 2022, which later moved forward after the Virginia Supreme Court ruled that the airline was not fully immune from such claims. Madison himself filed the case in December and requested a jury trial, and Delta Air Lines recently filed a motion to dismiss the lawsuit on June 3, USA Today reported. As of the latest reports, Delta and Endeavor have not publicly responded to the allegations.

Delta Air Lines ‘Window Seat’ Lawsuit of 2025

This is not the first time Delta has been sued by passengers. There was another such incident in 2025, when passengers filed lawsuits against Delta and United over another issue involving “window seats” without windows. The lawsuits allege that airlines charged extra for “window seats” but in some cases were placed in seats with blank walls instead of windows, the BBC reported.

The cases are said to involve more than 1 million passengers per airline, with claims amounting to millions of dollars. Lawyers called the practice “deceptive” and “illegal” and said customers would not have paid the extra fee if they knew there were no windows.
