Fidelity data breach compensation up to $5,000: How to file a claim

Fidelity Investments clients affected data breach Things that happen in August 2024 may entitle you to a cash payment – but only if you submit your claim before this summer’s deadline.

A proposed $2.5 million class action settlement has been reached in federal court over a data security incident that occurred between August 17 and August 19, 2024, in which an unauthorized third party gained access to Fidelity’s computer network and may have obtained customers’ personal information, including names, Social Security numbers, financial account and routing numbers, and driver’s license information.

Fidelity denies wrongdoing but has agreed to settle.

Are you qualified?

If you are a U.S. resident and received a data breach notification from Fidelity, or your bank account and routing numbers were compromised during the incident, you may be eligible to file a claim.

Joint account holders with a compromised account can only submit one claim.

What can you receive?

The settlement provides three types of benefits to eligible class members:

Cash payment: All class members can apply for a cash payment, currently estimated at $100. The final amount may be higher or lower depending on how many people file a claim.

Out-of-pocket damages: If the data breach caused you documented financial losses, such as the cost of identity theft, the cost of a credit freeze, the cost of replacing an ID or credit monitoring services, or even the cost of postage and gas to resolve the fraud, you may be able to claim compensation of up to $5,000. You will need to provide proof such as bank statements or receipts. Notes written by yourself are not enough, but can be used to supplement other documents. California residents may also request an additional $50 under the California Consumer Privacy Act.

Identity Theft Protection: All class members are eligible for two years of CyEx Financial Shield Complete, which includes $1 million in financial fraud coverage and monitoring.

How to make a claim

The fastest and easiest way to submit is online www.FidelityDataSettlement.com. Paper claim forms can also be downloaded from the website and mailed.

All claims must be received or postmarked by July 27, 2026.

Settlement period

Class members who do not want to participate in the settlement and wish to preserve their rights to sue Fidelity must formally opt out by June 26. Opting out means giving up any settlement benefits.

If you take no action, you will not receive any payment and will waive your right to sue Fidelity for the data breach covered by the settlement.

The court will hold a final approval hearing on July 9.
