KOLKATA: The Calcutta High Court has warned the European Commission against preventive detentions and arrests ahead of the final stretch of Bengal polls on Wednesday, stressing that any restrictions on fundamental freedoms must follow due process.A bench of Justices Arijit Banerjee and Partha Sarathi Sen on Tuesday, while disposing of a writ petition regarding the detention of Trinamool workers ahead of the polls, expressed hope that the EC would be “fair, efficient, impartial, without any political or other bias and act strictly in accordance with the law”.The HC emphasized the primacy of Article 21 and added that restrictions on individual freedoms can only be done through due process.TMC MP Kalyan Banerjee said in the petition that an earlier order suspending the implementation of the committee’s April 21 internal memorandum on preventive detention was being flouted. He alleged random arrests of party workers and MPs and claimed police were targeting supporters of CM Mamata Banerjee in Bhowanipore, where the BJP’s Suvendu Adhikari is her main opponent.The high court did not issue a formal order but reiterated its expectation that the EC will perform its duties in accordance with the law.
