What is the EB-5 Program?

The EB-5 program is a way to obtain a U.S. green card through investment. To qualify, a person must invest in the United States and create at least 10 jobs. The investment amount is high, but many people choose this option because it does not require a job offer or employer sponsorship, unlike most other employment-based green card categories.

What is a visa announcement?

The Visa Bulletin is a monthly update issued by the Department of State. It shows the deadlines for different green card categories based on country of birth. If your priority date is earlier than the deadline, you can move to the next step in the process.

There are two important dates. The final action date is the date USCIS approves your green card. The filing date is the date on which you can file your I-485 petition.

According to the announcement, immigrant visa numbers are issued in order of priority date. If demand in a certain category or country is too high, oversubscription will occur and a cut-off date will apply. Categories may even become unavailable if the limit is reached.

Officials also noted that if demand increases further during the year, “it will be necessary to immediately render the priority category ‘unavailable’ and no further number requests be fulfilled.”

How is the situation in other categories in India?

For Indian applicants, dates for other employment categories are unchanged from last month. The final action date for EB-1 remains April 1, 2023. The final action date for EB-2 remains July 15, 2014. The final action date for EB-3 is November 15, 2013.

Most Indian professionals apply under EB-2 and EB-3, and there are still chronic backlogs in these categories. EB-1 is for priority workers and top talent, while EB-2 is for professionals with advanced degrees, and EB-3 is for skilled workers.

Although the April announcement showed good progress, the date is now frozen at these levels.

Wider shifts in visa availability

The advisory said visa processing has been slowed in some countries due to government administrative and national security actions. As a result, the State Department has moved up dates for certain categories from other countries so that unused visas can be used in fiscal year 2026.

At the same time, the announcement warned that the date could be pushed back again if more people apply later or if policies change.

For Indian applicants, especially those planning to apply through the EB-5 route, the message is simple: opportunities may become limited, and circumstances may change rapidly.
